Welcome to Genie ISP. These Terms and Conditions ("T&C") are a legal agreement between you ("the customer") and Genie ISP ("we," "us," or "our"). By accessing and using our internet services, you agree to be bound by these terms. Please read them carefully before using our services.



1. Service Overview

Genie ISP is a prepaid internet service provider, offering high-speed, reliable internet services using various technologies, including broadband and mobile internet. We provide services to both residential and business customers. As a prepaid service, payment must be made in advance for the selected billing period to ensure uninterrupted service. Our services are designed to meet your internet needs with reliable, high-speed connectivity. These Terms and Conditions govern your access and use of Genie ISP's prepaid services. These T&C govern your access and use of Genie ISP’s services.

2. User Responsibilities

By subscribing to and using Genie ISP services, you agree to:

  • Provide accurate and complete information during the sign-up process.

  • Keep your account details confidential, including your password.

  • Use the service lawfully and comply with all applicable local, state, and federal laws.

  • Avoid using the service for any harmful, illegal, or disruptive purposes, such as:

    • Spamming

    • Hacking

    • Infringing intellectual property rights

    • Engaging in fraudulent activity

    • Distributing malware or engaging in malicious attacks

3. Acceptable Use Policy

You agree not to misuse our services, including but not limited to:

  • Reselling the service without our express written consent.

  • Exceeding data limits or circumventing bandwidth management tools.

  • Engaging in activities that interfere with other customers' access to our services or that disrupt our network.

If we detect that you are using our services in a way that negatively impacts our network or other customers, we may suspend or terminate your service.

4. Service Availability and Performance

  • Service Availability: While Genie ISP strives to provide uninterrupted service, we do not guarantee 100% uptime. Service interruptions may occur due to network maintenance, upgrades, or unforeseen outages.

  • Network Performance: Internet speeds and performance may vary based on factors such as network congestion, location, weather conditions, and device compatibility. Actual speeds may differ from advertised speeds.

5. Billing and Payments

​

  • Billing Cycles: Genie ISP services are billed on a 30 day prepaid cycle.

  • Payment Methods: We accept payments via credit card, debit card, cash and other methods listed on our website.

  • Late Payments: Failure to make payments on time may result in suspension or termination of services. If your service is terminated for non-payment, a reactivation fee may apply.

  • Refund Policy: Payments are non-refundable unless otherwise stated in your service agreement.

6. Data Usage and Bandwidth Management

​

  • Data Caps: Certain plans have data caps. If you exceed your data cap, your internet speeds may be reduced or if it is a hard cap, your service will be expired for the remainder of the billing cycle.

  • Bandwidth Management: During peak times, Genie ISP may implement bandwidth management techniques, including slowing data speeds, to ensure fair distribution of resources across users.

  • Data Deprioritization: Prepaid customers may experience slower speeds during times of network congestion.

7. Service Termination

​

  • Customer-Initiated Termination: You may terminate your service at any time by contacting our customer support. Early termination fees may apply if you are within a contract period.

  • Genie ISP-Initiated Termination: We reserve the right to terminate or suspend your service without prior notice if you violate these T&C, fail to make timely payments, or engage in illegal activities.

  • Return of Equipment: If you terminate service, you are responsible for returning any leased equipment provided by Genie ISP. Failure to return equipment may result in additional charges.

8. Privacy and Data Collection

Your use of Genie ISP services is subject to our Privacy Policy, which outlines how we collect, use, and protect your personal information. By using our services, you consent to the data practices described in our Privacy Policy.

9. Security and Fair Usage

​

  • Account Security: You are responsible for securing your account and for any unauthorized use. Notify us immediately if you suspect any unauthorized access to your account.

  • Fair Usage: Genie ISP reserves the right to limit or throttle services for customers who exceed fair usage thresholds or engage in excessive or disruptive data consumption that affects other users.

10. Limitation of Liability

To the fullest extent permitted by law, Genie ISP shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of, or inability to use, the service. This includes but is not limited to lost profits, data loss, service interruptions, or network outages.

11. Indemnification

​

You agree to indemnify and hold harmless Genie ISP, its affiliates, officers, and employees from any claims, liabilities, damages, costs, or expenses arising from your use of the service, violation of these T&C, or infringement of any third-party rights.

12. Changes to Terms

​

Genie ISP reserves the right to update or modify these T&C at any time. Changes will be posted on our website, and continued use of the service after the effective date of the changes constitutes acceptance of the modified terms.

13. Governing Law

​

These T&C shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles. Any disputes arising from this agreement shall be resolved in the courts of Tallahassee, FL.

15. Force Majeure

​

Genie ISP is not responsible for delays, interruptions, or failures in service caused by circumstances beyond our reasonable control, including but not limited to natural disasters, strikes, power outages, or technical failures.

16. Equipment Policy and Fees

Customer-Owned Equipment:


You may use your own compatible equipment with our services. A programming fee and activation fee may apply when setting up customer-owned equipment. These fees will be clearly communicated prior to service initiation and are non-refundable. Genie ISP is not responsible for the performance or support of customer-owned equipment. Any technical issues arising from such equipment are the customer’s responsibility.


Genie ISP-Provided Equipment:

Leased Equipment: Equipment provided by Genie ISP, such as modems or routers, is leased and remains the property of Genie ISP. You are responsible for maintaining the equipment in good condition and must return it upon termination of service. Failure to return the equipment may result in a replacement fee, which will be equivalent to the current market value of the equipment.


Purchased Equipment: If you purchase equipment from Genie ISP, it becomes your property upon full payment. You are responsible for maintaining and repairing purchased equipment.


17. Technical Support

  • Support for Genie ISP Equipment: We provide technical support for equipment leased or purchased from Genie ISP.

  • Support for Customer-Owned Equipment: Technical support for customer-owned equipment is limited. We may assist with initial setup; however, any ongoing issues with customer-owned equipment are the customer's responsibility.



18. Amendments

This T&C including the Equipment Policy, may be updated periodically. Customers will be notified of significant changes through our website or via email. Your continued use of the services after changes have been made constitutes acceptance of the new terms.
